Le dimissioni di Ignazio Marino a Roma hanno scatenato molti commenti, interessante quello sul fallimento politico da una parte del sistema dei partiti, ma dall’altra anche di quei sindaci come Marino cresciuti e presentati “contro” le strutture partitiche, ricordando che proprio Marino uscì dalle primarie del PD romano come scelta “popolare” o - con il senno di poi – di sola immagine. 

Ma se non vanno bene né i partiti né gli esterni, dov’è allora il futuro della politica italiana? Credo che la risposta sia chiara: non funzionano “questi” partiti senza ideologie e senza “anima”, scheletri vuoti incapaci di dare speranze, ma troppe volte i tecnici che vengono proposti a cariche pubbliche non hanno alle spalle una sufficiente caratura e esperienza “politica” per affrontare le situazioni. Le realtà sono sempre più serie e difficili delle fantasie e soprattutto degli slogan che possono piacere alla “pancia” dei cittadini in campagna elettorale, ma che alla lunga non reggono il peso dei problemi quotidiani.

Il Comune è per esempio una istituzione dove il cittadino si sente coinvolto in prima persona, ma un sindaco che pur voglia migliorare la propria città non può reggere se gli gioca “contro” la struttura comunale (anche se spesso il sindaco avrebbe tutte le ragioni) perché quella stessa struttura lo distruggerà. Il vero potere nei comuni è infatti nell’apparato, nella burocrazia, nei dipendenti (e soprattutto nei dirigenti) che non cambiano quando cambia il sindaco, ma anzi lo condizionano per tutto: i malvezzi e i privilegi indebiti dei dipendenti comunali romani ne sono tragica conferma, perché Marino passa, ma quei privilegiati restano. Alla stesso modo un sindaco cadrà se vorrà andare qualche volta “contro” i partiti che lo sostengono in consiglio comunale e che possono farlo cadere – sfiduciandolo - in ogni momento.

La struttura legislativa del nostro paese infatti è diventata folle e un qualsiasi sindaco di buona volontà e assoluta onestà (l’ho provato sulla mia pelle) si ritrova presto a dover scegliere. Se usa tutti i bilancini delle forme e delle procedure alla fine non combinerà nulla e davanti ai suoi cittadini farà la figura del nullafacente e dello stupido solo perché passerà sempre troppo tempo dall’atto della decisione a quello della realizzazione. Se – invece – il sindaco sarà “decisionista” e romperà le scatole state tranquilli che qualcuno presto lo inforcherà davanti a un Magistrato che riuscirà a bloccare tutto perché - per chi sta a tavolino, vede le carte mesi dopo, non rischia nulla e non vive le quotidiane emergenze di una città - la “forma” è tutto. Non parliamo poi se quel sindaco manderà a quel paese la propria parte politica che magari gli chiede favori più o meno leciti: sarà dipinto come politicamente traditore e pericolo pubblico. 

Credo che la politica oggi si trovi davanti a un bivio: c’è chi la fa per rubare o rubacchiare e mira a un incarico per i suoi possibili vantaggi (e temo allora lo farà sempre, aggirando la legge) ma purtroppo la politica è diventata oggi impossibile da gestire per qualsiasi persona che voglia operare concretamente, velocemente e correttamente. I cittadini credono di eleggere un “loro” sindaco, ma in realtà con le normative attuali spesso eleggono un ostaggio: quanti se ne rendono conto?

Tornando al punto di partenza non si può allora pensare di far eleggere un “tecnico”, un “grande nome” o una più o meno nota e brava persona (Ignazio Marino era un chirurgo) catapultandolo in una situazione dove sono indispensabili anche conoscenze tecnico-politiche e esperienze amministrative. Proprio qui salta fuori tutta la pochezza del sistema politico italiano dove non ci sono più “scuole” di partito e non solo dal punto di vista ideologico, ma anche per la preparazione progressiva all’incarico, facendo un passo alla volta. Per essere buoni sindaci bisogna saper dirigere strutture complesse o macinare anni in consiglio comunale, così come è assurdo eleggere deputati o deputate solo per il loro nome o il bell’aspetto, ma che non sanno nulla di gestione pubblica. 

Ma se fino qui avete condiviso il mio ragionamento vi rendete conto come sia assurdo il nuovo sistema elettorale – l’ “Italicum” - che Renzi ha appena imposto, dove non si eleggono ma si “nomineranno” persone (chi sarà messo a capolista nel collegio di fatto sarà automaticamente eletto). Non importa se saranno intelligenti o cretine, oneste o disoneste, con esperienza o meno: conterà soltanto l’essere un giocattolo nelle mani dei leader. Ma se il sistema non funziona e viene perpetuato con leggi elettorali scritte apposta perché continui a non funzionare, come potrà mai migliorare la gestione del nostro povero paese?

Ipocrisia



La London University ha deciso: non avrà più alcun legame accademico con i colleghi israeliani per protestare contro l’occupazione dei territori palestinesi. Anche il comune di Reykjavik – capitale dell’Islanda – boicotterà Israele e i suoi prodotti agricoli e industriali per lo stesso motivo. 

Siamo veramente alla follia: si potrà criticare tutto di Israele tranne che sia l’unica democrazia vera del Medio Oriente eppure questi saccenti soloni “democratici” non sollevano il problema degli assassini del Califfato e dell’ISIS, le norme barbare della Jihad islamica, gli attentati di Al Quaeda, le distruzioni di Palmira o in Iraq, le decapitazioni in Arabia Saudita e le impiccagioni in serie in Iran, le condizioni della donna dal Pakistan alla Nigeria, oppure i vari regimi stile Corea del Nord in giro per il mondo…no, i “cattivi” di questo mondo sembrano solo gli israeliani. 

Chissà se in Islanda sanno che il loro boicottaggio includerà quindi anche i parlamentari arabi liberamente eletti alla Knesset, o le imprese ebraiche o palestinesi che operano in Israele con le loro decine di migliaia di lavoratori che proprio solo lavorando in Israele trovano il modo di sfamare le proprie famiglie. Immaginate invece, al contrario, i commenti se a boicottare Israele fosse stata una università o una città tedesca… ci rendiamo conto dell’incredibile cumulo di ipocrisie e di tabù che ci accompagnano ogni giorno?

La truffa delle Poste Italiane



Ha ragione Corrado Passera, che in anni non lontani è stato capace di trasformare Poste Italiane in una struttura agile ed efficiente rispetto al lento e tardo carrozzone inefficiente di prima: LA PRIVATIZZAZIONE DI POSTE ITALIANE E’ UNA TRUFFA AI DANNI DEI CITTADINI. 

Le poste sono un servizio pubblico da gestire bene e far rendere, non da svendere ai privati (stranieri, per di più!) per i loro interessi secondo una logica di mero profitto. 

I risultati sono sotto gli occhi di tutti: chiudono gli uffici periferici e montani, peggiora il servizio con le lettere che saranno recapitate non più in 24 ore ma in 4 giorni, mentre dal 1 ottobre (ma non lo ha detto nessuno) l’affrancatura di una lettera è aumentata di un altro 20% passando a 95 centesimi (erano 70 centesimi un anno fa: + 36% !). 

Altro che asfissiante pubblicità sul “cambiamento siamo noi”: gli italiani (tutti) perdono un patrimonio ed è assurdo che nessuno lo dica, ne parli, si preoccupi. Sta succedendo lo stesso malaffare come con la CASSA DEPOSITI E PRESTITI, l‘altro grande “salvadanaio” italiano a cui Renzi ha cambiato i vertici per motivi incomprensibili, salvo che far fare gli affari a pochi furbetti. 

In Poste Italiane è la grande cassa del risparmio postale che fa gola a tutti ma questi temi non appassionano, non hanno spazio sulla grande informazione. Certo che se Berlusconi avesse fatto queste cose chissà che clamori, ma questo è un governo di “sinistra”, con l’iperipocrita maghetto di Firenze che fa e disfa quello che vuole…

Business rules


When we talk about business, everyone has a personal opinion to complete the deal in their own way.Often they exceeded the criteria, and regulations, just out of habit or hearsay, almost never the rules you want to believe are imposed by International Chamber of Commerce are really such. How to get out? Let's read the article, and if you want at the bottom of page you leave your commentary.

The following information will give you a better insight into the actual conditions that are acceptable to the real buyers and sellers in this business as opposed to all of the nonsense that has been perpetrated by the brokers and others that simply do not understand this business.

First, let’s put to rest many of the things that are incorrect and inaccurate about this business of buying and selling instruments.

Consider the following corrections to items that are pervasive throughout the brokers’ network, continue to be included in Letters of Intent, have been incorrectly applied to these transaction and are never a part of a real agreement between the seller and the buyer:

1.       First and foremost, the days of the buyer standing in the public square and dropping his pants while the seller hides in the dark and is "protected" by some broker that calls himself the "mandate" are gone from this business, never to return.

2.       The LOI can never become a contract. This is contrary to contract law. The seller and the buyer will always enter into an enforceable commercial contract/agreement. The LOI is just that, an expression of the buyer’s interest or intention. More than 95% of the time, the LOI is written by a broker, not by the seller and, for the most part, these brokers have just cut and pasted information that they obtained from other brokers. Thus all of the conflicts and errors in the  are copied and pass along from joker to joker (err..i meant to say, broker).

3.       Banking coordinates are never conveyed in a LOI. These are very confidential and are not the business of the broker network. In fact, banking coordinates are never conveyed in an agreement. Banking coordinates are only conveyed principal to principal.

4.       The laws of perjury do not apply to any commercial document,  or agreements. This is contrary to contract law and it is impossible for someone to perjure themselves in a letter of intent or interest.

5.       The term “no proof” means just that.

6.       There are no rules, regulations. Acts, ordinances or laws (including the US. Patriot Act of 2001) that require a buyer to produce a proof of financial capability prior to acquiring any instruments.

7.       There is no agency or department of any Government that approved the private sale of Medium Term Notes (MTNs) or Bank Guarantees (BGs) and there is no department that issues a “fed number” for MTNs. This is all joker-broker nonsense.

8.       Banks do not endorse fee agreements, contracts or LOIs. This action would place a financial liability on the bank and they cannot and will not incur that liability on behalf of their depositors.

9.       Banks do not issue irrevocable conditional bank purchase orders (ICBPO), or any purchase orders, period. In fact, a bank is precluded from incurring any liability on behalf of a depositor. And, the words “irrevocable conditional” form an oxymoron. No western world bank will issue a MT543, as it is a liability on behalf of the bank. In fact, as of September 1, 2003, the MT543 is gone from the banking world.

10.     Issuing banks do not enter into agreements to sell their financial instruments and the buyer’s banks do not enter into agreements to purchase the financial instruments. The agreement is always between the buyer and the seller. And no banker or securities officer is going to act on behalf of the buyer or seller until and unless there is an agreement in place.

11.     Collateral first is the most misunderstood phrase. Collateral first does not mean that the actual instruments move to the buyer before payment. It means that the seller must provide an invoice setting forth the details of the instruments, before the payment is made. There is no longer such a thing as a collateral first settlement via Euroclear and there is no such thing as a “collateral first“ DVP settlement, these are not the same settlement types.

12.     Buyer’s confidential documents (passport, resolution, client information sheet, banking coordinates) are not sent through the brokers’ network. This always results in the documents being shopped around the world. These documents are only sent on a principal to principal basis, period.

13.     There is no such thing as “due diligence” by some “agency” for seasoned instruments. The buy/sell transaction between private parties is private and does not require the approval of any governmental body or agency.

14.     As a result of the post-September 11 rules on wire transfers of funds, it is no longer possible for buyers to move cash funds in amounts over US$500M without the funds being stopped and investigated. Accordingly, offers that set forth tranches of $1b, $5b and more, are just pure nonsense.

15.     The ICC in Paris, France, is not an enforcement, adjudication or legislative body. They are simply an information body. However they have recently published the ICC769e concerning the NCNDA. Butr, the ICC has no jurisdictional authority or standing in any commercial agreement.

16.     Contract law sets forth that there cannot be any conflict of jurisdictional oversight to an agreement. Accordingly, an agreement cannot contain multiple jurisdictions as the controlling laws. Example: “this agreement is governed by the laws where the buyer and the seller reside and the ICC. Paris, France”.  Or “this agreement is governed by the laws of the USA, UK, Hong Kong, Switzerland and Germany” were written by someone that know nothing about the law, period.

17.     Bank guarantees are never on any screen (DTC or Euroclear) for screening, authentication or settlement. All BGs must be transacted via standard non-Euroclear DVP protocol settlement procedures.

18.     Medium term notes (MTNs) are only on Euroclear, not on DTC, for screening, authentication and settlement. All MTNs and bonds on Euroclear must be transacted via standard Euroclear DVP protocol settlement procedures.

19.     Some of the webs are starting to issue bank promissory notes. These notes can be posted and settled on Euroclear, via standard Euroclear DVP protocol procedures.

20.     Prior to January 1, 2003, it was possible to settle on Euroclear with a collateral first settlement. The seller provided the buyer with the invoice containing all of the instrument and Euroclear codes, including the blocking code. The buyer would then screen the instruments, block (delivery) the instruments in its name and then pay the seller via wire transfer of funds. Euroclear called this a “free delivery” as the instruments were blocked in the name of the buyer without any funds being delivered (payment) at the same time. There were too many incidents where the funds never were wired, causing both the seller and Euroclear big problems. So, as of January 1, 2003, there are no more “free deliveries”.. All instruments on Euroclear must be transacted via standard Euroclear dvp protocol settlement procedures.

21.     Standard Euroclear DVP protocol settlement procedures and standard non-Euroclear DVP protocol settlement procedures, do not require and, in fact, preclude the need for a proof of funds, proof of capability, financial capability letter, MT760, MT543 or MT799. This is handled in the bank to bank call, after the agreement is signed and in place. Accordingly, no one will issue these documents, as they are replaced by the bank to bank confirmation call that must take place immediately after the agreement is signed.

22.     MT100 and MT103 are conditional swift transfers of cash funds. The MT100 has not been used for more than two years. The MT103 is the current method of sending a conditional swift transfer of cash funds. However, the MT103 is only used for fresh cut (new issue), funds first transactions and never for seasoned paper or a DVP settlement transaction.

23.     MT543 is a bank commitment or undertaking and is not issued by any US Bank and is not issued by most western european banks. Banks do not make commitments or undertakings on behalf of their depositors. If they were to do so, this would cause the bank to move liquid assets to the liability section of the balance sheet and bank simply will not do this. MT543s have been cancelled by the banking authorities and after September 1, 2003, are no longer used in the banking world.

24.     MT760 is not a proof of funds, blocking of funds, movement of funds or settlement document. It only has one purpose. Its purpose is for the actual movement of the bank guarantee (not MTNs or bonds) from the seller’s bank officer to the buyer’s bank officer.

25.     MT799 is a simple text message, sent bank to bank. In this business, this is used for a bank to bank proof of funds, only. The MT799 is not a form of payment and it is not a bank undertaking or promise to pay. It is simply a bank to bank confirmation of the funds on deposit, nothing more. And, all of these joker-brokers that modify the MT799 to make it look like a bank undertaking are just kidding themselves.

26.     Standby Letters of Credit (SBLCs) are not instruments that are issued, bought and sold at discounted prices. When a bank issues a SBLC, the price to the buyer is 100% of face value, plus the bank service charge for the instrument. And, the purchaser of the SBLC will ask the bank to place a restrictive endorsement on the SBLC, for the payment of a specific item of goods or services. All offers for large amounts of SBLCs at discounted prices are absolutely fraudulent offers.

27.     A fee protection agreement that states “to be determined” or “to be nominated” as the name of the paymaster for either the buyer’s side or the seller’s side is absolutely worthless. No prudent business person will issue a blank document. And, if you do not know the name of the seller’s side paymaster, then you do not have a valid offer and you do not have any way of delivering the Ready Willing and Able (RWA) letter to the seller.

28.     There is no such thing as slightly seasoned instruments. Instruments are either fresh cut (new issue that has not been registered with a buyer) or they are seasoned (instruments that have already been sold to one or more buyers). While the price of seasoned instrument can vary, the fact that they are either seasoned or not seasoned is binary in nature.

29.     There is no such thing as the “gray screen”. This is just joker-broker nonsense.

30.     There is no such thing as a “fed id” approving the acquisition of MTNs. This is just joker-broker nonsense.

31.     There is no such thing as a “fed pool” for MTNs. This is just joker-broker nonsense.

32.     There is no such thing as a “fed program” or  “fed trader”.  These are just terms created by the joker-brokers in this business.

Orgoglio Americano



Il giorno che è appena terminato, è una data già entrata nella storia. A Ground Zero, luogo simbolo degli attacchi, nel cuore di New York, il tempo si è nuovamente fermato e, nel silenzio, una campanella ha ricordato quel giorno di 14 anni fa. Uno per uno i nomi delle vittime sono stati ripetuti in una cerimonia che, dopo anni, è tornata pubblica sul luogo delle Twin Towers, per un momento di commemorazione collettiva.

"14 anni dopo gli attacchi terroristici dell'11/9, onoriamo coloro che abbiamo perso. Salutiamo coloro che garantiscono la nostra sicurezza. Ci leviamo piu' forti che mai". 

Lo ha scritto su Twitter il presidente degli Stati Uniti Barack Obama nel 14/mo anniversario dell'11 settembre. 



Questa è l'America dei nostri sogni, dei ricordi sempre vivi e della voglia di eccellere nonostante tante contraddizioni. I lettori che mi seguono sanno che ogni tanto viaggio negli USA, e non solo virtualmente, per analizzare punto per punto questo grande paese e cercare di cogliere le novità per capire meglio questa grande realtà. 

Anche quest’anno sono tornato preoccupato e scoraggiato e non solo perché del nostro paese nell’ultimo mese i media americani hanno parlato solo per l’immigrazione dall’Africa e lo sciagurato funerale mafioso a Roma in stile “Il Padrino” (immaginatevi la brutta figura e l’ironia che siamo riusciti ancora una volta a sollevare) quanto perché mentre da noi tutto sembra andare alla moviola e in modo rallentato in questi ultimi anni e soprattutto quest’anno gli Stati Uniti sembrano aver ripreso con slancio una ripresa economica che è ben più visibile dello “ zero virgola” italiano tanto strombazzato dai media e dal governo.

Scelte di strategia finanziaria azzeccate (uno dei pochi meriti di Obama), con “mani libere” all’esecutivo per salvataggio di banche e di imprese riuscendo – tra l’altro - a far pagare il prezzo delle loro bolle speculative del 2007-2008 anche (se non soprattutto) al resto del mondo.
Intanto il mercato immobiliare è tornato a tirare, così come di conseguenza l’ occupazione e la produzione industriale 

Questa rinnovata vitalità non nasconde pregi e difetti del modello americano, per esempio nel loro mercato del lavoro che è infinitamente più svincolato del nostro, ma dove una occupazione si trova subito – anche se magari provvisoria - ma comunque sempre legata alle capacità e volontà dell’individuo. Da noi si direbbe “meno tutelato” ma se uno è trattato male se ne va e di lavoro ne trova un altro il che porta ad un equilibrio tra domanda ed offerta ed è forse per questo che non c’è una strada dove nelle vetrine non si cerchino nuovi assunti con il “sogno americano” che così autoalimenta sé stesso. 

Soprattutto si nota - nelle piccole e grandi cose - come l’informatica, l’automazione e l’interconnessione dei servizi sia molto più avanzata che da noi semplificando la vita e riducendo i costi mentre restano diversi problemi di base come lo spreco di energia (ad esempio l’aria condizionata esagerata, magari con le porte o le finestre che restano aperte) e uno stile di vita spesso per noi assurdo. 

Vale per l’alimentazione e gli sprechi, visibili in molte famiglie, di apparecchiature, imballaggi e anche di cibo visto che porzioni e confezioni – come tutto, in America – sono sempre “extra large”.

In generale la ripresa è quindi anche basata su un consumismo esagerato e spesso forzato. 

Certo molte cose costano decisamente meno che da noi favorendo la ripresa: l’anno scorso la benzina costava intorno ai 4 dollari a gallone, ovvero circa 1 dollaro al litro. Il prezzo è sceso ora a 2,2 dollari a gallone: vi immaginate se in Italia la benzina costasse meno di 60 centesimi al litro e le autostrade – come negli USA – fossero gratuite? La ripresa economica nasce anche da qui ed è triste vedere invece come in Europa, nonostante il costo del denaro “ufficiale” sia quasi a zero, quello del petrolio il più basso di sempre e pur con l’Euro ormai stabile sia così difficile la ripresa. Ancora più difficile da noi dove investire è impossibile sia per una burocrazia assurda che per la difficoltà reale di poter ricorrere al credito. Così tutto è “impallato” e restiamo sempre più indietro.

Bank Comfort Letter (BCL)




BCL, which stands for Bank Comfort Letter, has been called by one expert, one of “the most widely used acronyms which are both unsafe and impracticable” in the hands of the Internet intermediaries, and which has been a prime reason “why past trades have failed” with those intermediaries who use it. Often called by other names, such as the ‘Bank Capability Letter’ or‘Bank Confirmation Letter,’ the BCL is simply a letter provided by the buyer’s bank to confirm that the buyer has sufficient funds to carry out a particular transaction.


The BCL is viewed as a flawed, inappropriate, dangerous, and “silly” method when employed by modern Internet intermediaries, for essential the same reasons that other similar procedures(e.g., the LOI, ICPO, etc) have been similarly viewed by experts – it is often misused and misapplied by greedy, overzealous, devious and misguided Internet joker broker types and agents to try to gain, for themselves, an undue control and advantage of the trading process with potential buyers, by essentially “cornering and boxing in” the would-be buyer to commit,upfront, to an offer so as to unduly and hurriedly secure or safeguard a commission for themselves from such a buyer, with total disregard as to whether the offer is genuine or not, or has been verified or not.

An Illustrative Example from Case of a Seller’s Offer to the Author’s Office

The above problem is manifested in about two basic ways.

A) Let’s take, for the purposes of an illustration, this particular offer received at the author’s petroleum consultancy office from a dealer who purported he was acting as a Mandate/Agent for refined JP54 & D2 products from Russia, through an entity that he claimed was connected with Russia’s OAO Gazprom and Ufa Refineries. He demanded that our potential buyer provide the following documents to initiate a purchase, in order for the buyer “to be considered as credible”: 

The Seller’s Basic Procedures for Sale on a C.I.F Basis:

Seller issues a Soft Corporate Offer (SCO) [This is a Sales letter outlining the seller’s offer] to Buyer

Buyer confirms the SCO and issues Company Bio, a Letter of Intent (LOI), and Bank Comfort Letter (BCL).

Seller issues Full Corporate Offer (FCO) which buyer endorses and returns.

Seller issues draft contract open for amendments.

Both parties confirm draft Contract by endorsing it.

Buyer and Seller lodge the contract in their respective banks and finalize the bank to bank process.

The first problem with this request for a BCL by an intermediary, is the issue of practicality and feasibility. For example, whereas this agent is asking that the interested buyer should first provide him a BCL, as a purely practical matter the reality is that generally Banks (i.e., in this case, the buyer’s bank) will usually not give BCLs without FIRST seeing the POP from the seller or supplier. To put it another way, the fact is that such matter usually always boils down to the so-called ‘chicken or the egg’ proposition. That is, on the one hand, if, in fact, the “seller”actually truly has the crude allocation in hand, then there is no reason why they would not immediately give a POP to a credible buyer. It is not possible to go around that. But, on the other hand, if the “seller” FIRST receives a BCL (and ICPO) from a potential buyer, then it’s quite possible, or perhaps even likely, that they then can go out on their own and shop around for the product. The simple reality is that, at least to this author’s own knowledge, most petroleum buying entities in operation, will not send an ICPO and BCL to a supposed seller without first receiving a POP, and ONLY if a supplier were to send a buyer a legitimate deal with a POP, will the buyer send supplier an ICPO and a BCL, even accompanied with permission to do a soft probe of the BCL.

Buyers cannot buy “nothing.” This seller, in fact, not even the seller but a third-party intermediary agent, is asking a buyer to disclose to them a vital financial information without even having seen or being shown a product, or knowing who they are dealing with and whether it’s a legitimate seller at all, in the first place.

Thirdly, whereas the impression being conveyed by such a seller who demands a BCL is that it is some kind of security and a conveyance of proof of financial capability or assurance of payment on the part of the buyer, the reality of the matter is that the BCL really confers no such security. Why? Because, in practice, with a great many number of banks, it often takes very little to for them to issue that document to a customer,especially if he is one of their prized accounts – whether that customer actually has the funds in his account with them, or not. In sum, if a customer were to actually provide a BCL for, say, $200 million (the value of one shipment of 2 million barrels of crude oil), the fact of such presentation would still be NO proof, nevertheless, that he is, in fact,good for the amount represented in the BCL, the $200 million. Or, even for anything close to that! Hence, asking for a BCL, or getting a copy of one in your hands, virtually proves nothing as to the financial capability of a buyer to buy a product. Even if a principal does disclose this information to an intermediary, what use is this information to them?

They cannot personally conduct a ‘soft probe’ so what business does an intermediary have asking another intermediary for this type of third-party information?”

Joker Brokers waste time in requesting non-sense documents. For example requesting a buyer for a Bank Confirmation Letters (BCL) or to provide Proof of Funds (POF) prior to the acceptance of offer and contract signing is foolish. Business confidentiality is paramount, as a full mining consulting firm can undertake no action to endanger its principals or clients, providing loose access to client banking is such an action. No serious buyer gives an untested vendor access to banking confidential.

In general only brokers, not principal Suppliers seem to request BCL's. This seems to be for the comfort of the brokers. However at most a BCL will only provide limited degree of financial capacity. A professional seller understands that a Buyer trying to provide premature proof of "Ready, Willing, and Able" (RWA) via a BCL does not guarantee purchase. It only says "I (the buyer) have money to buy something ", but it does not say "I (the buyer) will buy something from you."

BCL's never prove buyer's RWA for reasons detailed below, therefore requiring them is a waste of time and generally will kill your deals. Brokers who request a BCL need to consider that few serious Buyers will issue a financial statement of such confidentiality in today's International area filled with fraud, identity theft, piracy, and other financial threats. In a world of rampant fraud no serious buyer allows soft probes into their banking. 

A serious Seller is concerned about one thing only, closing a sale. Where the Buyer's funds come from, at what stage in a transaction Buyer might choose to fund a certain account, and other matters are simply not the Seller's concern as long as the Buyer is able to perform as required under the contract. A fully funded LC at the appropriate stage of transaction is the most appropriate method of demonstrating RWA, such an Irrevocable payment is useless until the documents passing title to the Buyer are produced. No money, no product, no product documents no money. This is the most secure and safe protocol protecting Buyers and Sellers Globally.

The Joker Broker
This is a letter to us from a former admitted Joker that is now a closer!

What do you do when you receive an offer of over one hundred millions barrels of JP-54 and more than five millions ton of D2 requiring an ICPO with BCL or Soft Probe, NCND and IMFPA up front?

This is pure Broker rubbish - throw it in your rubbish bin. No delivery port can handle such volumes. Do you realize how much fuel you are talking about here? Do you know those huge VVLC tankers, which are as long as 3 soccer fields put together? Well this quantity is 17 of those huge tankers!!!! Which refinery can handle such quantities? Which Port has enough spare tank space for this “lake” of fuel? Which pipeline will bring this “river” of fuel to the Port? And which refinery will produce it? 

Answer: “It simply does not exist”. I know that brokers don’t like to hear it, but I have to tell you that you are filling up peoples’ email systems with nonsense from brokers and it is spoiling your name. Maybe you are getting these so-called “deals” from good people, but perhaps they are getting them from the Joker Broker “Daisy-chain”. Please listen to good advice - instead of sending 100 emails with Broker nonsense which does not work, find just one…… only one….. Good deal where you are talking directly to the Seller (legal owner of the product) or his Mandate and you will save yourself (and all of us) a lot of unnecessary work. Let me give you (for free) some good advice, coming from years and years of experience in this business: (It cost me a lot of money and years of hard work with no successful deals to gain this experience, but I am giving it to you for free, so this is your lucky day to get something valuable for free!!).

1. When a deal starts off with “send ICPO with BCL or Soft Probe, NCND and IMFPA” this is “Broker Language”. Those that know this “Broker-Language” know that this means: “I was a Joker-Broker - I don’t have any product for sale and I don’t know anyone who has got any (real) product for sale - so I want you to give me an Irrevocable Purchase Order with your full financial details disclosed, so that I can then run around with your order and your money in my hands, looking for product and the next thing you will be seeing is your company details and your banking details exposed to the world, running around on the internet between thousands of other Joker-Brokers”. I was a Joker and I have closed a five deals now after years of the rubberish.I am a closer and recommend The Joker Brokers from any that would like to at least learn this business!

This is what this language means - I suggest you “learn the language” and please do not send me EVEN ONE “deal” which starts off with this procedure - please just put them straight into the rubbish bin - which is exactly the place that I will put them when someone sends them to me.

2. Next valuable tip:
Question: ‘What do the real buyer’s want?’ -
Answer: Real buyers want to receive offers ONLY from real sellers.
Next Question: ‘How do I recognize a “real seller” from one who is not?
Answer: A ‘real seller’ actually owns the product - he is the legal title holder of the product and 98% of the time he is not offering this product to the “Joker-Broker world” for sale. So you need to be sure of the circumstances as to why a “real seller” is offering “real product” for sale to a broker network when he can just call up Shell Oil or ExxonMobil or BP or Total Oil and sell it direct to them as they are always needing product. 

QUESTION: “WHAT DO I LEARN FROM THIS? ”Answer: “I learn that I will not receive “real” offers from a Broker Daisy-Chain. I will only receive them from a real seller or his real appointed Mandate”.

3. Next valuable tip: NOBODY gives oil products away for nothing. About 95% of deals which have a low fixed price are “scams” and there is no product available. They are the fabrications of the Joker-Broker brigade. A real seller will in 95% of all cases only sell with a discount off a Platt’s based price. (Why would a Seller sell D2 for somewhere in the $400’s when he can get over 50% more, anytime from any major oil company? - Sellers are not that stupid!!)

4. The remaining 5% of deals which sell for a fixed price are mostly “Spot” deals and they have a time window of a maximum of about 3 days. Within this time, they are normally sold and delivered because nobody can afford the tank storage space costs for any extra days - it eats up all the profit. Unfortunately the Joker-Broker brigade pick up on some of these deals and continue to offer them all around the world for months and months after they have already been sold. The Brokers will swear to you that the deals are genuine, as they may have been at the time, but what use is a so-called “genuine” deal when it was already sold and delivered two months ago?

5. A “real buyer” who has money in his bank to buy product with, wants ONLY to receive offers from a REAL seller who: (a) actually owns the product (b) the product is already ‘in tank’ at the delivery port with tank receipts issued, or (c) the product is in the pipeline on the way to the port, or (d) the seller has bought crude oil which is on the way to the refinery and the product he wants to sell will be available in 30 to 45 days at the loading port, and (e) the Seller has some kind of documentary proof (Soft POP) that the product is real and available.This “REAL SELLER” will always be prepared to offer product to a genuine buyer on an FCO and he will always be in a position to give some sort of partial POP (proof of product) in exchange for POF (proof of funds) and he will normally be ready to do this bank-to-bank. What does this mean? It means that you should ask your so-called “seller” if he can produce (bank-to-bank if he likes) some sort of evidence to a buyer/buyer’s bank to prove that the product is real, owned and available for sale. If the seller cannot do this, you need to find out why, because in most cases it will be found that he can't produce this because he doesn’t have it, because the deal is a fake.

6. In any “real deal” there will never be a huge discount offered with huge commissions to intermediaries - it just doesn’t happen. So when you see a huge discount and/or huge commissions to intermediaries, it is more than likely that the deal is fake.

7. Please be aware that very often someone in the Broker fraternity hears about a deal which, at the time, may be genuine. This deal is then widely circulated amongst brokers, even months after the product has been “sold and delivered”. This is called “chasing after rainbows”.

8. Whenever you see JP54 offered in huge quantities, throw it in the bin. Remember that the largest airline in the world uses only 7,800,000 barrels per month and that is “worldwide” at numerous different destinations!! Also remember that the largest airline in the world will not be buying from us - they have long term, long standing arrangements direct with producers. So do yourself a favour and put all “huge” JP54 offers where they belong - straight into the rubbish bin.

9. Do some research on the delivery ports? Whenever anyone is offering you more product than the available tank capacity in the delivery port, it is obviously a fake deal.

10. Take some good advice - treat every deal as a “fake deal” until it is proven to be genuine - you will be right in over 90% of the cases….. The large majority of deals (in fact, almost all of them) running around the broker world are either fake deals, or they might have been available for a 3-day window but are still circulating days, weeks and even months after the deal was closed and delivered.

11. Lastly - only deal with people who are either a genuine Seller Mandate (with official Mandate Appointment Letters from the Seller - and beware… there are many fakes!!!) or not more than one step away from such a genuine Seller Mandate. On everything else you will find out that you are wasting your valuable time….. And mine (which by the way, I am not going to allow to happen).

Dietro le quinte di Renzi


Il premier Matteo Renzi è furbo, fin troppo. Anche se i sondaggi parlano di una caduta del suo apprezzamento in un anno dal 65% al 35%  Renzi piace a molti italiani per la sua parlantina sciolta, la concretezza delle problematiche che solleva, il voler mettere in cantina molti vecchi arnesi della politica, il presentarsi come “volto nuovo” della sinistra autodichiaratasi moderata e sociale. 
Poi c’è un “lato B” di Renzi che pochi sottolineano, eppure conta nelle cose importanti.

Per esempio lo abbiamo visto (troppo) applaudito all’ex FIAT che pur ha portato la sua sede all’estero danneggiando un bel po’ il fisco italiano, lo si nota incerto nei riguardi di quei “poteri forti” (assicurazioni – banche – compagnie petrolifere – società parastatali - autostrade) che non vengono minimamente sfiorate da tagli di costi e tariffe e continuano così contenti ad accumulare profitti paurosi. Ma soprattutto Renzi non mi piace quando tratta questioni finanziarie enormi, non si capisce nell’interesse di chi.

Che motivo c’era, per esempio, di allontanare in piena estate Franco Bassanini dalla Cassa Depositi e Prestiti, oltretutto in anticipo sulla scadenza di legge, per mettere a guardia dei risparmi degli italiani (la “Cassa” ha circa  460 miliardi di attivo di cui circa 250 miliardi di depositi postali, quasi più di tutto il debito greco!) un uomo poco noto come Claudio Costamagna, per anni però – guarda caso - dirigente alla Goldman Sachs, ovvero il più potente istituto bancario speculativo americano, concausa principale della crisi finanziaria che ha colpito prima gli USA, nel 2007 e che poi si è propagata in Europa e nel mondo con danni incalcolabili? 

Questo mostro bancario apparentemente silenzioso che vive sui drammi di miliardi di persone (anche Papa Francesco ha ricordato i guasti causati da queste enormi finanziarie senza volto e senza scrupoli) e che ha avuto come “consulenti” anche persone come  Mario Draghi, Romano Prodi e Mario Monti. Si aggiunga che Costamagna siede tuttora in diversi consigli di amministrazione di società quali Luxottica e è Presidente di Salini-Impregilo. 

Perché insomma nominare Presidente di una società a controllo pubblico proprio un uomo cresciuto negli ambienti della finanza e della grande industria privata? 
Non dimentichiamoci che la Casa Depositi e Prestiti ha in mano i pacchetti di controllo delle residue aziende strategiche a controllo pubblico come l’ Eni e le sue controllate Enel e Finmeccanica. Ancora di più Renzi è stato enigmatico quando ha sottolineato che “l’Italia si trova oggi a un passaggio decisivo per la ripresa. Le riforme strutturali, l’attrazione degli investimenti, e una politica di bilancio basata sul taglio delle tasse sul lavoro stanno riportando il Paese alla crescita. In questo contesto il rafforzamento del ruolo di CDP risulta ancora più cruciale”.

Dall’Ansaldo alla Fiat dalla Pirelli a Italcement però tutti i “gioielli di famiglia” italiani stanno prendendo la via dei capitali esteri che ne hanno acquistato solidi pacchetti di azioni a prezzi di saldo. Ma se l’Italia si impoverisce sempre più nel nome delle “alleanze strategiche” (dove sono  sempre gli altri a comprare e fare gli affari e gli italiani a vendere) come potranno mai crescere il lavoro e l’economia nel nostro paese? 

E se Renzi alla fine fosse solo il paravento di altri, la faccia simpatica di chi tiene in mano i fili della finanza mondiale e avesse messo gli occhi proprio su CDP? Si spiegherebbero allora molte cose…

QUANDO C’ERA LUI I TRENI ARRIVAVANO IN ORARIO…



Mito: Devi ringraziare il Duce se esiste la pensione.


Realtà: In Italia la previdenza sociale nasce nel 1898 con la fondazione della “Cassa nazionale di previdenza per l’invalidità e la vecchiaia degli operai”, un’assicurazione volontaria integrata da un contributo di incoraggiamento dello Stato e dal contributo anch’esso libero degli imprenditori. Mussolini aveva in quella data l’età 15 anni. L’iscrizione a tale istituto diventa obbligatoria solo nel 1919, durante il Governo Orlando, anno in cui l’istituto cambia nome in “Cassa Nazionale per le Assicurazioni Sociali”. Mussolini fondava in quella data i Fasci Italiani e non era al governo.

Tutta la storia della nostra previdenza sociale è peraltro verificabile sul sito dell’Inps. La pensione sociale viene introdotta solo nel 1969. Mussolini in quella data è morto da 24 anni.

Mito: Il Duce garantì l’assistenza sanitaria a tutti lavoratori.

Realtà: Con la legge dell’11 gennaio 1943, n. 138, con il nome di Ente mutualità fascista – Istituto per l’assistenza di malattia ai lavoratori, venne istituita la prima Cassa Mutua di Assistenza di Malattia che offriva tutele solo ai lavoratori del pubblico impiego. Tutti gli altri non ne avevano diritto.

Il diritto alla tutela della salute per tutti nasce il 13 maggio 1947, data in cui viene istituita l’INAM, Istituto Nazionale per l’assicurazione contro le malattie, riformato nel 1968, con la legge n. 132 (cosiddetta “legge Mariotti”), che assisteva tutti i lavoratori, anche coloro che dipendevano da imprese private.

Nel 1978, con la legge n. 833 del 27 dicembre, veniva estesa, oltre che l’indennità retributiva in caso di malattia, anche il diritto all’assistenza medica con la costituzione del Servizio Sanitario Nazionale, con decorrenza del 1º luglio 1980 (la cosiddetta “riforma sanitaria”). La norma era chiaramente ispirata al National Health Service (NHS) britannico.

Mito: La cassa integrazione guadagni è stata pensata e creata dal Duce.

Realtà: La cassa integrazione guadagni (CIG) è un ammortizzatore sociale per sostenere i lavoratori delle aziende in difficoltà economica. Nasce nell’immediato dopoguerra per sostenere i lavoratori dipendenti da aziende che durante la guerra furono colpite dalla crisi e non erano in grado di riprendere normalmente l’attività. Quindi la cassa integrazione nasce per rimediare ai danni causati dal fascismo e della guerra che hanno causato milioni di disoccupati.

Mito: Il Duce ha avviato il progetto della bonifica pontina.

Realtà: I primi lavori di bonifica cominciarono nel 1924 con l’istituzione del Consorzio di Bonifica di Piscinara che avviò la canalizzazione delle acque del bacino del fiume Astura, riprendendo un progetto di Leonardo Da Vinci, interessato anche lui su una ipotesi di bonifica. Addirittura i primi lavori furono eseguiti da i Volsci (intorno al VI secolo a.c.) che, con un sistema di drenaggio a base di cunicoli rimasti celebri e forse insuperati, riuscirono ad assicurare la disciplina delle acque per cui la zona divenne prosperosa e fertile. Mussolini, quindi, non ha avviato un bel niente.

Mito: Ai tempi del Duce eravamo tutti più ricchi.

Realtà: Mussolini permise agli industriali e agli agrari di aumentare in modo consistente i loro profitti, a scapito degli operai. Infatti fece approvare il loro contenimento dei salari.

Nel 1938, dopo 15 anni di suo operato, la situazione economica dell’italiano medio era pessima, il suo reddito era circa un terzo di quello di un omologo francese. Dobbiamo quindi ringraziare il Duce se oggi gli stipendi in Italia sono considerevolmente più bassi di tutti quelli dell'area europea.

Mito: Il Duce ha fatto costruire grandi strade in Italia.

Realtà: Il programma infrastrutturale che prevedeva la costruzione delle strade completate durante il ventennio cominciò già durante il quinto governo di Giovanni Giolitti, avendo constatato l’impossibilità di uno sviluppo industriale in mancanza di solide strutture.

Mito: Il Duce è stato l’unico uomo di governo che abbia veramente amato questa nazione.

Realtà: “Mi serve qualche migliaio di morti per sedermi al tavolo delle trattative”

Già… proprio amore.

Mussolini amava talmente l’Italia che:

– ha instaurato una dittatura
– ha abbassato tutti i salari
– ha firmato i Patti Lateranensi
– ha portato il paese al collasso economico
– ha tolto la libertà ai cittadini italiani
– instaurando le leggi razziali ha scritto una delle pagine più infami e vili della storia italiana.

Voleva così bene al suo popolo da farlo sprofondare in una guerra civile quando fu esautorato dal potere creando la Repubblica Sociale Italiana. Un paese già allo sbando a causa dell’armistizio dell’8 settembre e provato dalla guerra (condotta da lui con esiti a dir poco disastrosi) venne dilaniato ancora di più tra cosiddetta” Repubblica di Salò” e Italia liberata.

Tra l’altro, non è vero neppure che che “quando c’era lui i treni arrivavano in orario”.

Come spiega questo articolo dell’Indipendent si tratterebbe infatti di un mito derivante dalla propaganda durante il Ventennio.

La puntualità dei treni era infatti per la propaganda fascista il simbolo del ritorno all’ordine nel paese ma, in realtà, è solo grazie alla censura sistematica delle notizie riguardanti incidenti e disservizi ferroviari che questa immagine si è potuta formare.

Cari nostalgici del fascismo,

Mussolini è finito appeso a testa in giù con le persone che prendevano a calci il suo cadavere.

Crisi imminente?


Ci sarà un crollo finanziario negli Stati Uniti entro la fine del 2015? Sempre più stimati esperti finanziari stanno avvertendo che siamo proprio sull’orlo di un’altra grande crisi economica. Naturalmente questo non significa che accadrà. Gli esperti hanno sbagliato in passato ma alcuni indizi sembrano suggerire che una nuova crisi finanziaria potrebbe essere alle porte.

Ci sono più aree problematiche al mondo che situazioni stabili. Nessuna nazione importante in Occidente può rimborsare i propri debiti. Lo stesso vale per il Giappone e la maggior parte dei mercati emergenti. L’Europa è un esperimento fallito. La Cina è una bolla enorme, in termini di mercati azionari,mercati immobiliari e sistema bancario ombra. Gli Stati Uniti sono il paese più indebitato del mondo e hanno vissuto al di sopra dei propri mezzi per oltre 50 anni.

Così vedremo l’esplosione di due bombe gemelle: una del debito da 200 trilioni di dollari e una di derivati da 1,5 quadrilioni che porterà ad una storica distruzione della ricchezza, con i mercati in calo di almeno 75-95 per cento. Il commercio mondiale si contrarrà drammaticamente e vedremo un enorme disagio in tutto il mondo.

Hanno ragione? Lo sapremo presto.

Il Pellet da riscoprire


Oggi parliamo di pellet e in particolare del pellet di abete.

Il pellet di abete è, a torto o a ragione, probabilmente il più blasonato in Italia. Pellet di abete rosso o di abete bianco, la sostanza non cambia, sono equiparabili e nel tempo hanno trovato moltissimi estimatori.

Non a caso la maggior parte di pellet di abete proviene da Austria e Germania, due Paesi che oltre ad avere grande disponibilità di boschi di abete, hanno anche un’attitudine all’efficienza e al lavoro preciso. Si spiega anche così il blasone del pellet di abete rosso (o bianco): spesso e volentieri sono marche di pellet austriache o tedesche, quindi prodotti fatti con criterio, senza aggiunte o mancanze, nel rispetto dei processi. I prezzi del pellet di abete risentono di questo doppio fattore, da un lato la qualità dei processi produttivi, dall’altro della forte domanda di prodotto; e infatti sono prezzi spesso superiori alla media, non sempre però a fronte di qualità altrettanto superiore. 

La certificazione ENPlus A1, forse la più importante, è tipica di molti pellet d’oltralpe, ed è nata per premiare una filiera, un processo produttivo, che va da produttore a dettagliante. Tutto deve essere fatto con criterio e secondo certi standard, a partire dalla materia prima utilizzata e dal produttore che deve seguire un processo molto chiaro. La maggioranza degli utilizzatori di pellet cerca il pellet d’abete, rosso o bianco non fa tanta differenza. E alcuni produttori o Distributori poco seri, anzi assolutamente non seri, si approfittano di questa situazione per mettere in atto furbate, spacciando pellet per quello che non è.

Ancor prima della provenienza, quindi, occorre prestare attenzione alle certificazioni, e anche ai numeri di certificazioni, garanzia di qualità. Una volta appurato questo, si può procedere più tranquilli nella scelta del pellet. E a quel punto non fa differenza se di abete rosso, bianco, di rovere, di faggio o altri legnami. A quel punto subentrano altri fattori di valutazione, come prezzo, resa, residui di cenere.

I pellet di abete sono davvero tanti, i più noti sono probabilmente lo Pfeifer, il Firestixx, il Norica, il Binderholz il Mayr Melnhof. La maggioranza comunque del pellet austriaco. 

Meglio faggio o abete?

Ma il miglior pellet è di abete o di faggio? Il pellet di faggio ha generalmente una resa maggiore ma anche un consumo maggiore e un residuo di cenere più corposo.
Il pellet di abete, in quanto conifera (come il pino), ha una resa analoga a quella del faggio o di poco inferiore, brucia più lentamente e comporta quindi un consumo inferiore. Anche il residuo di cenere dalla combustione del pellet di abete spesso è inferiore a quello generato dal combustibile di faggio.

Ci sono differenze importanti, ma che vanno poi unite alle considerazioni sulla marca di pellet che si utilizza nonché alla propria stufa o caldaia. Una cosa fondamentale che bisogna sempre tenere in mente è che ogni stufa o caldaia lavora in maniera diversa, ognuna ha le sue tipicità che valorizzano al meglio un combustibile legnoso piuttosto che un altro. Quindi a parità di qualità di pellet, una stufa può performare meglio con un tipo che con un altro, a seconda della durezza e delle altre caratteristiche di cui bisogna tenere conto.

Alla domanda sul pellet, su quale sia meglio tra faggio e abete rispondiamo con un “dipende”, e vi invitiamo a fare prove pratiche con la vostra stufa. Le risposte possono essere diverse, e nessuna è più giusta o sbagliata. I prezzi del pellet di faggio sono tendenzialmente più bassi rispetto a quelli di abete. Anche questo è un fattore da tenere in dovuta considerazione, soprattutto a parità di performance, è verosimile che tutti preferiamo risparmiare un po’.

Altri tipi di pellet

Non solo abete e faggio, non sono gli unici due tipi di pellet presenti in commercio. Come in ogni mercato in crescita, l’offerta è varia e in evoluzione; si possono trovare pellet di rovere, di pino, di castagno, di larice, misti, anche di cereali. In particolare ci sentiamo di spezzare una lancia a favore del pellet di pino, che per la nostra esperienza si sono sempre dimostrati essere pellet di qualità (Pellexo Bianca in particolare). Hanno tutti caratteristiche diverse che si possono sposare bene o meno bene con le stufe e con le caldaie a pellet. Ma stiamo attenti a dare il giusto peso al tipo di legname di cui è composto il pellet: è senza dubbio un fattore da considerare, ma ce ne sono altri che si tendono a trascurare ma che in realtà hanno la stessa importanza o addirittura maggiore.

Pensiamo ai processi di produzione, che in un pellet certificato ENPlus A1 sono garantiti. Pensiamo alla presenza o meno di agenti leganti o di additivi all’interno del pellet; e non dimentichiamoci degli aspetti visivi e olfattivi, da valutare con attenzione per essere sempre maggiormente preparati in fase di acquisto di pellet e di valutazione dei tipi di pellet.
